General Terms & Conditions (GTC)
§1 Scope of Application
(1) These General Terms and Conditions apply to all contracts between Marcus Rother (hereinafter referred to as the “Provider”) and consumers within the meaning of § 13 German Civil Code (BGB) concerning:
• Online course series (“Science of Being Human”)
• Online live sessions (e.g., Breathwork)
• In-person appointments in the field of Bodywork
• Individual Private Yoga in-person sessions
(2) Deviating conditions of the customer shall not apply.
(3) The offers are currently directed exclusively to consumers (B2C).
§2 Subject Matter of the Contract
The Provider offers the following services:
- Multi-week online live course series with additional permanent streaming access to recordings (“Science of Being Human”).
- Individual scheduled online live sessions (e.g., Breathwork).
- Individual in-person appointments in the field of Bodywork.
- Individual Private Yoga in-person sessions.
The specific service description results from the respective offer page or announcement.
§3 Conclusion of Contract (Onlineshop WooCommerce)
(1) The presentation of services on the website does not constitute a legally binding offer.
(2) By completing the ordering process, the customer submits a binding offer.
(3) The contract is concluded through explicit acceptance or provision of the service.
§4 Conclusion of Contract (Calendly)
When booking via Calendly, the contract is concluded upon confirmation of the appointment.
§5 Conclusion of Contract (WhatsApp – Private Yoga Group Sessions)
(1) Booking of Private Yoga group sessions may be made via the WhatsApp community.
(2) Registration takes place through a binding message in the respective session chat, in which the participant declares their intention to participate.
(3) Allocation of places follows the “first come, first serve” principle.
(4) The contract is concluded once the Provider confirms participation or the participant is added to the participant list.
(5) Payment is made on site in cash or via PayPal.
§6 Prices and Payment
(1) The prices stated at the time of booking shall apply.
(2) Payment is made as a one-time payment.
(3) Payment methods:
• Stripe
• PayPal
(4) The service will only be provided after receipt of payment.
(5) For Private Yoga group sessions booked via WhatsApp, payment is made on site in cash or via PayPal.
§7 Science of Being Human – Course Regulations
(1) The courses consist of live sessions as well as supplementary recordings.
(2) Participants receive lifetime streaming access to the recordings after full payment.
(3) Downloading the content is not permitted.
(4) The content is protected by copyright.
(5) Distribution to third parties is prohibited.
(6) The Provider reserves the right to make organizational adjustments, provided the overall character of the course is maintained.Data transfer to the United States is based on Standard Contractual Clauses.
§8 Online Breathwork Sessions
(1) These are scheduled live events.
(2) Participation takes place exclusively live online.
(3) No recording will be provided.
(4) The event serves self-experience and does not replace medical treatment.
§9 In-Person Appointments (Bodywork & Private Yoga)
(1) Bodywork 1:1 and Private Yoga sessions are individual in-person appointments.
(2) Private Yoga group sessions may be booked via the website or via the WhatsApp community.
(3) These are not medical, therapeutic, or healing treatments.
(4) Participation takes place at the participant’s own responsibility.
(5) Health restrictions must be communicated in advance.
(6) In case of doubt, medical advice must be obtained before participation.
§10 Cancellation Policy
Online Breathwork Sessions
• Free cancellation up to 1 hour before the start
• No refund thereafter
Science of Being Human Courses
• Withdrawal with full refund up to 14 days before the start of the course
• No refund thereafter
• Rebooking possible for important reasons
• The statutory right of withdrawal remains unaffected by this contractual cancellation policy.
Bodywork 1:1 and Private Yoga (including group sessions)
• Free cancellation up to 24 hours before the appointment
• Full cancellation fee thereafter (consent).
§11 Right of Withdrawal
(1) Consumers generally have a statutory right of withdrawal of 14 days.
(2) For date-specific events within the meaning of § 312g para. 2 no. 9 BGB, there is no right of withdrawal.
(3) In the case of digital content, the right of withdrawal expires once:
• the customer expressly agrees that execution begins before the withdrawal period expires, and
• confirms that they thereby lose their right of withdrawal.
§12 Participation Requirements & Health
(1) Participation takes place at the participant’s own responsibility.
(2) The offers do not replace medical or therapeutic treatment.
(3) Breathing exercises and physical exercises may have physiological effects.
(4) Participants are obligated to independently assess health limitations.
(5) Contraindications are communicated before sessions.
(6) In case of doubt, medical advice must be obtained before participation.
§13 Liability
Emails are sent via an SMTP system.(1) The Provider is liable without limitation in cases of intent and gross negligence.
(2) In cases of simple negligence, the Provider is liable only for breach of essential contractual obligations.
(3) Liability for health reactions resulting from failure to observe instructions or contraindications is excluded.
(4) Participation takes place at the participant’s own responsibility.
§14 Recordings
(1) Live sessions within the Science of Being Human courses are recorded.
(2) By participating, the participant agrees to the recording.
(3) Camera and microphone may be deactivated.
(4) Use of recordings outside the platform is prohibited.
(5) Online Breathwork Sessions are not provided as recordings.
§15 Copyright
All content is protected by copyright.
Reproduction, distribution, publication, or public access without explicit written consent is prohibited.
§16 Technical Requirements
Participants are responsible for:
• Stable internet connection
• Suitable hardware
• Functioning audio/video equipment
There is no entitlement to repetition in the event of technical problems on the participant’s side.
§17 Final Provisions
(1) German law shall apply.
(2) Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
Payment Terms
§1 Scope of Application
These payment terms apply in addition to the General Terms and Conditions to all services offered.
§2 Prices
(1) The prices stated at the time of booking shall apply.
(2) All prices are final prices pursuant to § 19 German VAT Act (UStG) or include statutory VAT (where applicable).
§3 Payment Methods
For online bookings, the following payment methods are available:
• Stripe
• PayPal
For Private Yoga group sessions booked via WhatsApp:
• Payment on site in cash
• Payment on site via PayPal
§4 Due Date
(1) For online services (shop or Calendly), payment is due immediately upon conclusion of the contract.
(2) Course access will only be activated after full payment has been received.
(3) For Private Yoga group sessions booked via WhatsApp, the payment claim arises upon binding confirmation of participation and must be settled on site.
§5 Default of Payment
(1) In case of default of payment, the Provider is entitled to claim statutory default interest pursuant to § 288 BGB.
(2) Further statutory claims remain unaffected.
§6 Refunds
(1) Refunds are granted exclusively in accordance with the cancellation and withdrawal provisions stated in the GTC.
(2) Refunds will be made using the same payment method used for the original transaction, unless otherwise agreed.
§7 Non-Use of Service
Failure to participate in booked services does not entitle the customer to a refund, unless cancellation was made in accordance with the GTC.
§8 Payment Processing by Third-Party Providers
When paying via Stripe or PayPal, the respective terms and data protection provisions of the payment service provider shall apply additionally.
The Provider has no influence over the processing of payment data by these providers.
Participation Terms
§1 Scope of Application
These participation terms apply in addition to the General Terms and Conditions for:
• Science of Being Human online courses
• Online Breathwork Sessions
• Private Yoga (individual and group sessions)
• Bodywork 1:1
By booking, the participant agrees to these terms.
§2 Personal Responsibility & Health Condition
(1) Participation takes place at the participant’s own responsibility.
(2) The services offered serve self-experience, personal development, and physical practice.
(3) They are not medical, therapeutic, or healing treatments.
(4) Breathing exercises and physical exercises may have intensive physiological and psychological effects.
(5) Participants are obligated to independently assess whether health limitations or contraindications exist.
(6) In case of doubt, medical advice must be obtained before participation.
(7) Contraindications are explained before the respective sessions.
§3 Contraindications (especially Breathwork)
Participants may not participate or may only participate after medical clearance in cases including:
• Serious cardiovascular diseases
• Epilepsy
• Severe mental illnesses
• Pregnancy
• Untreated high blood pressure
• Recently performed surgeries
Responsibility for medical suitability lies exclusively with the participant.
§4 Technical Requirements (Online Offers)
(1) Participants are responsible for:
• Stable internet connection
• Functioning audio/video equipment
• Suitable space for performing physical exercises
(2) There is no entitlement to repetition in case of technical problems on the participant’s side.
§5 Conduct During Live Sessions
(1) Participants commit to respectful conduct.
(2) Disruptions of the session must be avoided.
(3) The Provider is entitled to exclude participants in case of serious disruptions.
In this case, there is no entitlement to a refund.
§6 Recordings (Science of Being Human)
(1) Live sessions within the Science of Being Human courses are recorded.
(2) By participating, the participant agrees to the recording.
(3) Camera and microphone may be deactivated.
(4) The recordings are provided exclusively within the platform.
(5) Distribution, reproduction, or publication is prohibited.
§7 No Recordings for Breathwork Sessions
Online Breathwork Sessions are not recorded or provided as part of the product.
§8 Disclaimer & Limitation of Liability
(1) Participation takes place at the participant’s own responsibility.
(2) The Provider assumes no liability for health reactions if instructions or contraindications were disregarded.
(3) The Provider is liable without limitation in cases of intent and gross negligence.
(4) In cases of simple negligence, the Provider is liable only for breach of essential contractual obligations.
§9 Copyright & Usage Rights
(1) All content is protected by copyright.
(2) Participants receive a simple, non-transferable right of use for personal use.
(3) Streaming access for Science of Being Human is lifetime, but exclusively for personal use.
(4) Distribution to third parties is prohibited.
§10 Data Protection & Confidentiality
(1) Participants undertake to treat personal information of other participants confidentially.
(2) Screenshots, recordings, or captures by participants are prohibited.
§11 Exclusion of Participants
The Provider is entitled to exclude participants in case of:
• Violation of these participation terms
• Disrespectful behavior
• Disruption of the session
There is no entitlement to a refund in this case.
